By accessing or using this website, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree, do not use this site.

5. Limitation of Liability

Under no circumstances shall www.bmdperformance.shop, its owners, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages that result from the use or inability to use this site or products purchased through it—even if BMD Performance has been advised of the possibility of such damages.Certain jurisdictions may not allow limitations on implied warranties or the exclusion or limitation of certain damages, so these limitations may not apply to you.

6. Typographical Errors

If a product is mistakenly listed at an incorrect price, BMD Performance reserves the right to cancel any orders placed for that product at the incorrect price. If your payment has already been processed, a refund will be issued for the difference.

7. Return & Refund Policy

All sales are final.

No returns are accepted on transmissions, special order items, or custom-built products.

Any exception is at the sole discretion of BMD Performance. If a return is approved, a Return Merchandise Authorization (RMA) will be issued, and a 20% restocking fee will apply. The item must be unused and in original packaging. Return shipping is the customer’s responsibility.

8. Order Cancellation

Orders may be canceled within 24 hours of placement if production or fulfillment has not started. After 24 hours, cancellations are subject to review and may incur fees depending on the work completed.

9. Use of Site

You agree not to use this site for unlawful, abusive, or harassing behavior. Impersonating BMD Performance staff, uploading malicious content, or attempting to disrupt the website's operations will result in account termination and possible legal action.

10. User Content and Participation

BMD Performance is not responsible for user-generated content (e.g., reviews, comments) on this site. We reserve the right to monitor, edit, or remove content we deem inappropriate, defamatory, or in violation of intellectual property rights.

11. Indemnification

You agree to indemnify, defend, and hold harmless BMD Performance, its owners, staff, and service providers from and against all claims, damages, costs, and expenses, including attorney’s fees, arising from your use of the site or breach of these Terms.

12. Governing Law and Jurisdiction

These terms shall be governed by the laws of the State of Arizona, U.S.A., without regard to conflict of law principles. Any disputes arising out of or relating to the site or transactions conducted on it shall be resolved in state or federal courts located in Maricopa County, Arizona.

If any provision of these Terms is found unlawful or unenforceable, that provision shall be deemed severable, and the remainder will remain valid and enforceable.

BMD Performance reserves the right to update or modify these Terms at any time without prior notice. Changes will be posted on this page with the updated effective date. Continued use of the site constitutes acceptance of the modified Terms.
